Rental
Scheduled rental rate begins when equipment leaves Powell Equipment lot and continues until returned. Customer agrees to give Powell Equipment Services a 2 day notice if rental schedule need be changed.
Condition of Equipment
Customer acknowledges receipt of the described property. The parties agree that Powell Equipment Services and the customer inspected the property at the time of delivery to and acceptance by customer and that the property was in good and serviceable condition.
Equipment Location
Customer will not permit said property to be relocated to any other site other than site stated in rental schedule.
Loss, Theft, Damage or Destruction
Customer shall provide and maintain protection against loss, theft, damage or destruction of the rental property.
Operation
Customer shall follow all operation guidelines provided with equipment. Follow daily equipment inspection check sheet prior to use. Equipment operator will be one holding current certification of operation if required. Follow all safety practices while in operation.
Reasonable Wear and Tear
Customer is responsible for any changes in the condition of the equipment during the rental period. Reasonable wear and tear accepted. Reasonable wear and tear is only the normal deterioration of equipment caused by ordinary and reasonable use in an 8 hour day/40 hour week.
Cleaning Fee
A cleaning fee of $50.00 will be applied on items returned unclean.
Limitation of Liability
In no event shall Powell be responsible to customer or any other party for any loss, damage or injury caused by, resulting from or in any way connected with the Equipment as required hereunder, or Powell’s failure to repair or replace non-working Equipment or Powell be liable for any incidental, consequential, punitive or special damages. Customer acknowledges and assumes all risks inherent in the operation, use and possession of the Equipment from the time the Equipment is delivered to customer until the Equipment is returned to Powell and will take all necessary precautions to perfect all person and property from injury or damage from the Equipment.
